TERMS & CONDITIONS

Welcome to My Heart-Space Venue.

​

We are committed to providing a peaceful, welcoming space for workshops, meetings, therapy sessions, wellness events, celebrations and private gatherings.

​

By confirming your booking, you acknowledge that you have read, understood and agree to these Terms and Conditions. 

The Heart Studio Venue
1. Our Spaces

Bookings may include one or more of the following spaces:

  • The Heart-Space Venue

  • Private Consulting Room

  • Covered Patio

  • Private Garden

 

Only the spaces confirmed on your booking may be used.

2. Booking Confirmation

Your booking is confirmed once:

  • We have accepted your booking.

  • The required deposit has been received.

  • You receive written confirmation from My Heart-Space Venue.

 

Quotes are valid for 7 days, unless otherwise stated.

 

3. Payments

Unless otherwise agreed:

  • A 50% deposit is required to secure your booking.

  • The remaining balance must be paid 7 days before the event.

  • Bookings made within 7 days of the event require full payment immediately.

  • Access to the venue will only be granted once payment has been received.

 

4. Cancellations, Refunds & Postponements

All cancellation requests must be submitted in writing via email. The cancellation date will be the date on which we receive your written notice. Telephone or verbal cancellations will not be accepted.

Cancellation Charges

More than 30 days before your booking

  • Full refund of payments received, less a 10% administration fee.

15–30 days before your booking

  • 50% of payments received will be refunded.

14 days or less before your booking

  • No refund.

 

Administration fees cover booking administration, payment processing, scheduling and reservation costs.

Postponements

 

We understand that circumstances sometimes change. One postponement may be accommodated without penalty if requested more than 21 days before the event date, subject to venue availability.

The new booking date must be confirmed within six (6) months of the original booking date. Only one postponement will be permitted per booking. Any further postponements will be treated as a cancellation.

If the postponed booking is of greater value than the original booking, the client will be responsible for paying the difference.

 

Changes to Confirmed Bookings

Reducing:

  • guest numbers;

  • booking hours;

  • hired spaces; or

  • services

after confirmation does not qualify for a refund.

 

No-Shows & Early Departure

  • Failure to arrive for a confirmed booking, or arriving significantly late without prior communication, will be regarded as a No-Show. No refunds or credits will be issued for no-shows. 

  • Should a client choose to end their event earlier than scheduled, no refund will be given for unused time.

  • Should we secure another booking for the same cancelled date and time, we may, at our sole discretion, refund a greater portion of your payment, less any administration costs incurred.

 

5. Changes to Your Booking

We will do our best to accommodate changes. Date changes are subject to availability and must be requested in writing.

Additional charges may apply.

6. Venue Use

The venue must only be used for the purpose stated on your booking. The person making the booking is responsible for:

  • all guests;

  • contractors;

  • facilitators;

  • suppliers;

  • equipment brought onto the property; and

  • ensuring all activities comply with applicable laws.

 

The venue must be left in a clean and tidy condition.

7. Set-up & Pack-down

Your booking time includes:

  • setup;

  • decorating;

  • the event;

  • cleaning; and

  • pack-down.

Please ensure everything is completed before your booking time ends. Additional time may be charged.

 

8. Respect for the Venue

Please help us care for this special space. Guests are expected to:

  • treat the property with care;

  • leave the venue clean and tidy;

  • dispose of rubbish responsibly;

  • respect gardens, plants and outdoor spaces; and

  • use furniture and equipment appropriately.

 

The booking holder is responsible for any loss, damage or excessive cleaning resulting from the event.

Repair or replacement costs may be charged where necessary.

 

9. Furniture & Decorations

Decorations are welcome provided they do not damage the property. The following are not permitted without prior approval:

  • nails or screws;

  • permanent adhesives;

  • confetti;

  • glitter;

  • open flames;

  • fireworks; or

  • smoke machines.

 

10. Noise

We ask all guests to respect our neighbours. Music and noise levels must remain reasonable. Management reserves the right to request that noise levels be reduced.

11. Parking

Parking is available on the property.

All vehicles and their contents are parked entirely at the owner's risk.

My Heart-Space Venue accepts no responsibility for:

  • theft;

  • damage;

  • accidents; or

  • loss of personal belongings.

 

12. Personal Belongings

Guests are responsible for their own belongings at all times. My Heart-Space Venue is not liable for lost, stolen or damaged property.

13. Safety

Guests use the venue at their own risk.  Children must be supervised by an adult at all times. Please take care around gardens, pathways, steps and outdoor areas. Please report hazards or accidents immediately.

 

14. Catering

Clients may arrange their own catering unless otherwise agreed. All caterers and service providers must comply with venue rules.

 

15. Alcohol, Smoking & Illegal Substances

Alcohol may only be served responsibly and in accordance with South African law. The booking holder is responsible for the behaviour of all guests. Illegal drugs and dangerous substances are strictly prohibited. Smoking and vaping are only permitted in designated outdoor areas. Smoking is not permitted inside any building.

16. Photography & Privacy

We may occasionally photograph the venue during events for marketing purposes. If you do not wish to appear in photographs, please let us know before your event. Please respect the privacy of others and do not photograph or record another person without their permission.

Your personal information is collected only for booking and communication purposes and is handled in accordance with the Protection of Personal Information Act (POPIA).

​

17. Professional Conduct

Facilitators, therapists, coaches and service providers using the venue are expected to:

  • conduct themselves professionally;

  • respect client confidentiality;

  • operate within the scope of their qualifications;

  • maintain appropriate professional boundaries; and

  • ensure their activities comply with all applicable laws and regulations.

 

My Heart-Space Venue provides the venue only and is not responsible for services delivered by independent facilitators or practitioners.

18. Pets

Pets are not permitted on the property.

19. Right of Admission

My Heart-Space Venue reserves the right to refuse entry or request any guest to leave the property if they:

  • become abusive;

  • behave in a disruptive manner;

  • damage property;

  • threaten staff or other guests;

  • engage in illegal activities;

  • create an unsafe environment; or

  • breach these Terms and Conditions.

Refunds will not be provided where removal is necessary due to misconduct.

20. Force Majeure

Neither party shall be liable for delays or failure to perform their obligations where such failure results from events beyond their reasonable control, including but not limited to:

  • severe weather;

  • natural disasters;

  • power or utility failures;

  • government restrictions;

  • civil unrest;

  • strikes; or

  • any event that makes the venue unsafe or unavailable.

 

Where possible, both parties will work together in good faith to reschedule the booking.

Should My Heart-Space Venue need to cancel a booking due to circumstances beyond our reasonable control, we will offer either:

  • a full refund of all monies paid; or

  • the opportunity to move the booking to another available date.

 

This shall constitute our full liability.

21. Liability

To the maximum extent permitted by law, My Heart-Space Venue, its owners, staff and landowners will not be liable for:

  • personal injury;

  • illness;

  • accidents;

  • theft;

  • loss of property; or

  • indirect or consequential damages,

except where caused by gross negligence or where liability cannot legally be excluded.

22. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.

23. Acceptance

By confirming your booking and making payment, you acknowledge that you have read, understood and agree to these Terms and Conditions.
